Terms of Use

These Terms of Use constitute a legally binding agreement between you and KLW Outpatient Aftercare regarding your access to and use of the Site. These terms apply to all visitors, users, and others who access the Site to learn about or request our nurse-led in-home recovery, clinical nursing, and personal support services.

You agree to use the Site solely for lawful purposes and in a manner that does not infringe upon the rights of, restrict, or inhibit the use and enjoyment of the Site by any third party. You agree not to use the Site to:

• Transmit any unlawful, threatening, defamatory, obscene, or offensive material.
• Attempt to gain unauthorized access to any portion of the Site, our electronic health record (EHR) systems, or any server, computer, or database connected to the Site.
• Introduce viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
• Engage in any activity that interferes with or disrupts the operation of the Site or our ability to dispatch clinical and non-medical staff.

Any request for services initiated through this Site (such as booking a consultation) is subject to verification, availability, and a comprehensive in-home or virtual intake and risk assessment conducted by a KLW Registered Nurse. Submitting a request through the Site does not guarantee enrollment or the initiation of services. KLW Outpatient Aftercare reserves the right to decline service if an individual's needs exceed the scope of care we can safely provide or if the home environment is deemed unsafe for our staff.

All content, design, text, graphics, logos, images, audio clips, and the selection and arrangement thereof on the Site are the exclusive property of KLW Outpatient Aftercare or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the content on the Site for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any material from this Site without the express prior written consent of KLW Outpatient Aftercare.

To the maximum extent permitted by applicable law, KLW Outpatient Aftercare, its officers, directors, employees (including RNs, LPNs, and NEMT drivers), and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in any way connected with your access to, use of, or inability to use the Site.

This limitation of liability applies to all damages of any kind, including but not limited to loss of data, loss of revenue or profit, property damage, and claims of third parties, whether based on contract, tort, strict liability, or otherwise, even if KLW Outpatient Aftercare has been advised of the possibility of such damages. This limitation of liability pertains strictly to the use of the website and does not waive any rights or liabilities pertaining to direct patient care as governed by Tennessee state law and medical malpractice statutes.

You agree to indemnify, defend, and hold harmless KLW Outpatient Aftercare and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms of Use or your use or misuse of the Site.

These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

You irrevocably agree that the state and federal courts located in any county within the State of Tennessee where KLW Outpatient Aftercare provides services shall have jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Use or your use of the Site.

If any provision of these Terms of Use is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.

KLW Outpatient Aftercare reserves the right, at its sole discretion, to modify or replace these Terms of Use at any time. We will post the revised terms on the Site. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
